GOLIATH INVESTMENTS INC. ("Goliath", "we", "us", or "our") respects your privacy. This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices you have. By using this website (https://goliathinvestments.net) or applying for funding through Goliath, you acknowledge the practices described below.

1. Information we collect

Depending on how you interact with Goliath, we may collect the following categories of information:

a. Identifiers and contact information

Full name, business name, EIN/SSN, date of birth, phone number, email address, physical address, and online identifiers such as IP address and device identifiers.

b. Financial information

Business bank account information, business and personal credit history and scores, deposit history, monthly revenue, existing debt obligations, payment processor data (when authorized by you), and information from third-party data providers we use to assess creditworthiness.

c. Commercial information

Information about the financing products you have inquired about or received, communications with our team, and any documents you provide (driver's license, voided check, bank statements, business formation documents, tax-related documents you elect to share).

d. Internet activity

Pages visited on our site, referring URLs, browsing patterns, session duration, and information collected through cookies and similar technologies (see Section 7).

e. Inferences

Underwriting analyses, risk scores, and product-fit assessments that we derive from the above categories.

2. How we use your information

We use personal information to: (a) evaluate funding applications and make credit decisions; (b) verify identity and prevent fraud; (c) service and manage funded transactions; (d) comply with legal, regulatory, and reporting obligations (including those imposed by state commercial financing disclosure laws); (e) communicate with you about your application, funded transaction, or new products; (f) operate, improve, and secure our services; and (g) market our services consistent with applicable law.

3. Who we share information with

We share personal information only with parties necessary to deliver the services you request and to comply with the law:

  • Service providers — payment processors, ACH originators, cloud infrastructure providers, identity verification services, bank-data aggregators (such as Plaid), credit bureaus, and fraud-prevention vendors — bound by confidentiality and data-handling obligations.
  • Funding partners — when applicable to a specific product or to provide you with multiple offers, we may share application data with vetted lending partners.
  • Legal and regulatory — law enforcement, regulators, courts, or other governmental entities when required by law or to protect Goliath's rights.
  • Corporate transactions — successors in interest in connection with a merger, acquisition, restructuring, or sale of all or a portion of our business.

We do not sell your personal information as that term is defined under the California Consumer Privacy Act, California Privacy Rights Act, or any other state privacy law.

4. Gramm-Leach-Bliley Act (GLBA) notice

As a financial services provider, certain information we collect about you is "nonpublic personal information" under the federal Gramm-Leach-Bliley Act. We restrict access to that information to employees and service providers who need it to deliver services to you or comply with the law, and we maintain physical, electronic, and procedural safeguards designed to protect it.

5. Equal Credit Opportunity Act (ECOA) notice

The federal Equal Credit Opportunity Act prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to enter a binding contract), because all or part of the applicant's income derives from any public assistance program, or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act. The federal agency that administers compliance with this law concerning this creditor is the Federal Trade Commission, Equal Credit Opportunity, 600 Pennsylvania Avenue NW, Washington, DC 20580.

6. Telephone Consumer Protection Act (TCPA) consent

When you provide your phone number on an application form or other communication, you consent to receive telephone calls and text messages from Goliath at that number, including by automated telephone dialing systems and prerecorded or artificial voice messages, regarding your application and our services. Consent is not a condition of any purchase. Message and data rates may apply. You may revoke consent at any time by replying STOP to any text message or by emailing admin@goliathinvestments.net.

7. Cookies and tracking

We and our service providers use cookies, web beacons, and similar technologies to operate the site, remember preferences, analyze traffic, and measure marketing performance. You can control cookies through your browser settings. Disabling cookies may affect some site functionality.

8. California privacy rights (CCPA/CPRA)

If you are a California resident, you have the right to:

  • Know what personal information we collect, use, and disclose;
  • Request a copy of the personal information we hold about you;
  • Request deletion of your personal information, subject to legal exceptions (including loan-servicing records we are required to retain);
  • Correct inaccurate personal information;

9. Data security

We implement administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, or disclosure. These include encryption in transit (TLS), encryption at rest for sensitive fields, access controls, employee training, and vendor due-diligence. No system is fully secure; please notify us immediately if you believe your information has been compromised.

10. Data retention

We retain personal information for as long as needed to deliver services, comply with legal and regulatory obligations (including recordkeeping required by federal and state commercial financing laws), resolve disputes, and enforce our agreements. Application files and funded-transaction records are typically retained for seven (7) years after the relationship ends.

11. Children's privacy

Our services are not directed to individuals under 18, and we do not knowingly collect information from anyone under 18.

12. Changes to this policy

We may update this Privacy Policy from time to time. We will post the updated version on this page with a new "Last updated" date. Material changes will be communicated directly when required.
