("Goliath", "we", "us", or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Eligibility
The Site is intended for business owners, principals, and authorized representatives located in the United States who are at least 18 years old. Goliath provides commercial financing products to qualifying businesses; nothing on this Site constitutes a consumer credit offer or extension of consumer credit.
2. Not an offer; underwriting required
Information on the Site is for general informational purposes only. Posted ranges, terms, speeds, and qualification criteria are illustrative — not binding offers. Any financing offer extended by Goliath is subject to full underwriting, written agreement, and applicable state and federal law. Completing the application form does not guarantee approval or funding.
3. Application and authorizations
When you submit an application or related documents, you represent that the information you provide is true, accurate, and complete to the best of your knowledge, and that you have the authority to submit it on behalf of the applicant business. You authorize Goliath to: (a) verify your identity; (b) obtain consumer and business credit reports; (c) request and review business bank account data and transaction history (including through authorized data aggregators such as Plaid); (d) contact your references, vendors, or financial institutions; and (e) use the information you provide for underwriting, risk-management, and product-fit assessment. Submitting materially false information may constitute fraud and is a ground for declining or rescinding an offer and reporting to law-enforcement.
4. No legal, tax, or financial advice
Content on the Site — including blog posts, guides, the glossary, and educational materials about commercial financing and state disclosure laws — is provided for general informational purposes and is not legal, tax, accounting, or financial advice. Consult a licensed professional in your jurisdiction before making decisions based on Site content. Commercial finance regulation evolves; we make no warranty that Site content is current.
5. Intellectual property
The Site and its contents — including text, graphics, logos, illustrations, and underlying code — are owned by Goliath or its licensors and are protected by copyright, trademark, and other intellectual-property laws. You may view and print Site content for your personal or internal business use, but you may not reproduce, distribute, modify, frame, scrape, or create derivative works without our prior written consent.
6. Prohibited conduct

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLIATH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY DECISIONS MADE BASED ON SITE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). You agree to indemnify and hold harmless Goliath and its affiliates from and against any claims, damages, liabilities, and reasonable attorney fees arising out of or related to (a) your use of the Site; (b) your violation of these Terms; or (c) your violation of any law or third-party right.
11. Governing law; dispute resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site that cannot be resolved through good-faith negotiation will be resolved by final and binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The seat of arbitration shall be Miami, Florida. Either party may bring an individual action in small claims court instead of arbitration. Class arbitration and class actions are not permitted.
12. Changes to these Terms
We may modify these Terms from time to time. Changes are effective when posted with a new "Last updated" date. Continued use of the Site after a change constitutes acceptance of the modified Terms.
